Eleven (11) Laws and Rights Must Be Known To Every Indian Citizen


All citizen of India can raise their voice on certain laws and rights, if so violated. The most common eleven laws and rights are:


  1. Woman cannot be arrested after 6 PM before 6 AM under Section 46 of Criminal Procedure Code as an exceptional circumstances. As per the amendment in the year 2005 by enact passed by Parliament sub- section 4 of Section 46 CRPC, woman not be arrested after sunset and before sunrise, any women can deny on such arrest.

  2. If any police officer refuse to register FIR, be jailed up to 6 months to 1 year under Section 166 A of Indian Penal Code. The Station House Officer is liable to receive any complaint given by all person, according to the nature of crime registration of FIR is considered, hideous crime as per offence not lodged FIR and negligent by concerned department or officers, punishable.

  3. Even 5 star hotels can’t prohibit the customers from portable drinking water and using it’s wash rooms as per Indian SRIUS Act, 1887. The customary right indulged to be protected by providing sufficient facilities as part of service to the consumer. 

  4. Live in relationship under Domestic Violence Act 2005 considered as legal, and also children born out of such relationship have full right on assets of his/ her father. The law safeguards the newly born child rights from young boy and girl indulged live in relationship.

  5. If a pregnant woman is fired by any company, punishable for 3 years imprisonment under Maternity Benefit Act, 1961. If the company either government or private has more than 10 employees then the pregnant woman employee is eligible to get 80 days preceding the date of her expected date of delivery, paid maternity leave as per Section 5 of Maternity Benefit Act, 1961

  6. In case of tax violation, notice to be issued on violated person before arrest by tax collection officer, time duration of custody to be decided only by Tax Commissioner, Income Tax Act 1961. The custody of the law violated person responsible by head department, not the executing officer in charge.

  7. Only woman constable can arrest woman, any woman can deny on the arrest by male constable as per Criminal Procedure Code. Considering the exceptional and safer strategy of feminine nature, the law protects the interest of women that restraint by contact or touch on body due to arrest process.

  8. Gas cylinder blasts while cooking food, the gas agency be liable to pay compensation of Rs. 50 Lakhs by lodging complaint to the nearest police station and submit the same to gas agency. Deficiency of service by providing leakage cylinder results in blast, occurrence of leakage will be considered for liability by gas agency.

  9. Any shop keeper can’t charge more than MRP of the product, customer can bargain, as per Maximum Retail Price Act, 2014. The product have it’s fixed Marginal value, the shop keeper cannot fix extra rate for his service on sale.

  10. Obscene Activity at a public place found, imprisonment for 3 months under Section 294 of Indian Penal Code. Police department usually misuse this provision of law, the activity to be obscene proof depends on spot.

  11. Prior notice to vacate a rent house to tenant to be given, no forcefulness, under Rent Control Act. The right of tenants to vacate the premises only on the prior notice period of 2 to 3 months.
